Terms of Use

These Terms of Use govern your use of Selective Teacher, published by HeyGhoshi.

Rather than write our own end-user licence agreement, Selective Teacher uses Apple's Standard End User Licence Agreement (the "Standard EULA"), which is the licence that applies to the app you downloaded from the App Store. You can read it here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

By downloading or using Selective Teacher you accept the Standard EULA and the additional terms on this page. Where this page says something the Standard EULA does not cover, this page applies. Where the two conflict, the Standard EULA prevails, because Apple's terms govern the App Store relationship.

Selective Teacher is an exam practice app that sets mathematics, reading and reasoning questions, marks your answers, and explains where you went wrong.

We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, resell, rent, sublicense, decompile, or reverse-engineer the app, except to the extent that such restriction is prohibited by applicable law.

We may release updates, add or remove features, or discontinue the app. We aim to give reasonable notice in the app or on this page before removing a feature you have paid for.

Selective Teacher offers optional paid features through the Apple App Store, either as a one-time purchase or as an auto-renewing subscription.

• Payment is handled by Apple. We never see or store your card details. Apple charges your Apple Account at confirmation of purchase.
• Auto-renewal. A subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Cancellation. Manage or cancel a subscription in Settings ▸ Apple Account ▸ Subscriptions on your device. Cancelling stops the next renewal; it does not refund the current period.
• Refunds are granted by Apple under Apple's policy, at reportaproblem.apple.com. We cannot issue App Store refunds ourselves.
• Price changes. If we change a subscription price, Apple will notify you before the change applies to your renewal, and you may cancel.

Selective Teacher uses automated processing to help you, and automated processing makes mistakes. Please read this section before relying on its output.

• Output may be wrong. The app can build a practice scene from a question, explain an answer, and read a question aloud. Those parts run on our servers, which pass the request to an AI provider. Depending on the feature, what we send is the text of the question, the text of your answer, or the photograph itself.
• Check anything that matters. Do not rely on the app as the only source for study, exam preparation, marking, or any decision that has consequences for you or someone else.
• It is a study aid, not professional advice. Selective Teacher does not provide legal, medical, financial, or educational-certification advice.
• Your own content. You are responsible for having the right to use anything you feed into the app, including photographs of printed material.

You agree not to use Selective Teacher to:

• break any law, or infringe anyone's copyright, trademark, or privacy;
• upload or process material you do not have the right to use;
• copy, resell, or redistribute the app or its built-in content, including any song catalogue, book, question bank, or artwork that ships with it;
• reverse-engineer, decompile, or attempt to extract the source code or the bundled models of the app;
• interfere with the app's operation, or attempt to obtain paid features without paying for them;
• use automated means to overload, scrape, or probe any service the app contacts.

If you breach these terms we may suspend or end your access to paid features. Cancelling a subscription is done through Apple, as described above.

In short: Practice stays on your device. Two things can leave it — the question you ask the AI about, and a question you deliberately share, which a person reviews before anyone else sees it.

Selective Teacher is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy. We do not warrant that the app will be uninterrupted or error-free, or that its output will be correct.

To the maximum extent permitted by law, HeyGhoshi is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of or inability to use Selective Teacher.

Nothing in these terms excludes any guarantee, warranty, or right that cannot lawfully be excluded, including under the Australian Consumer Law. Where our liability cannot be excluded but can be limited, it is limited to resupplying the service or paying the cost of having it resupplied.

These terms are governed by and construed in accordance with the laws of Australia. Any legal suit, action, or proceeding arising out of or related to these terms shall be instituted exclusively in the competent courts of Australia.

If any part of these terms is found to be unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. Apple is a third-party beneficiary of the Standard EULA and may enforce it against you.
